Court of Appeal judges on Thursday upheld the High Court ruling on rejecting National Super Alliance’s evidence that the President Uhuru Kenyatta met with Al Ghurair firm directors.

The five judge bench ruled that the newspaper cutting did not prove whether ballot paper printing was discussed or not.

According to the judges the evidence presented before them did not prove that the President influenced the awarding of the tender.

“Having considered evidence on record and law, we agree newspaper cuttings produced were hearsay and therefore not admissible.”

“Even if admissible, without proof the court cannot treat it as sufficient evidence.”
