A High Court judge has declined to issue an order barring Kiambu Governor James Nyoro from naming a deputy governor.
Judge James Makau said the former county boss Ferdinand Waititu has not shown what prejudice he will suffer should the incumbent appoint a deputy.
He further noted that the appointment of a DG is not a single act but a process, adding that the proceedings could not be turned into a hearing without involving the other parties.

Through his lawyer Kibe Mungai, Nyoro argued that his predecessor made changes to the petition filed last week. Apparently, he said, there was no order blocking him from naming a deputy.
Nyoro was last Friday sworn in as Kiambu’s third governor following Waititu’s successful ouster from office by the senate.
The latter became Kenya’s first governor to be impeached on grounds of gross violation of the Constitution and Public Finance Management Act; Crimes Under the National Law; and Gross Misconduct/Abuse of Office.
