The High Court  said that the IG Boinet and the DCI are in contempt of court for failing to produce Miguna Miguna in court contravening article 49 of the constitution.

The court has ordered IG Boinet and the DCI Kinoti to personally appear in court at 9 A.M  on February 6. The judge has said that they should also bring the accused with them when coming to court.

They have been given an alternative to release the lawyer if they do not wish  to appear in court.

The office of the ODPP has distanced itself from the failure by the police to produce Miguna Miguna in court. The prosecution said that it wrote the necessary letters to The IG Boinett and the DCI to have Miguna in court as per the court order.

The prosecution also said that they have not received any charge sheet in relation to Lawyer Miguna Miguna and therefore they have not commenced any criminal proceedings against him.
