Embakasi East MP Paul Ongili alias Babu Owino has lost his seat.
The first time legislator has had his August win nullified following a petition filed by his opponent, Francis Mureithi.
Justice Joseph Sergon while delivering the ruling said that the election was marred by wide-spread errors and malpractices.
Babu has ordered to pay Sh5 million as costs for the suit.
The judge had also ordered for a vote recount which showed that the legislator had won with 46,817 votes against Mureithi’s 42,501 votes.

The judge also noted that the former student leader had intimidated IEBC officials at the Constituency tallying centre while demanding for the Returning Officer, Nicholas Buttuk to declare him the winner.
There were also cases of violence at Soweto polling station, the Judge added, dismissing video evidence presented by the respondent saying that it did not meet the evident threshold.
Babu has however accused President Uhuru Kenyatta and Deputy President William Ruto of having a hand in the outcome of his case.
“The whole nation knows that this is a war between the president and the deputy president versus Babu. It is sad that the government is controlling the Judiciary,” he said.
“No one can destroy me. If either Uhuru or Ruto decides to vie against me in Embakasi East I will beat them seriously.”
