Justice Chacha Mwita has declined to issue orders stopping the 16% VAT on fuel that was filed by activist Okiya Omtatah and Francis Atwoli of COTU.

He said that the respondents were supposed to be served and appear in court. The matter was certified as urgent.

The two applicants had filed the petition to challenge the directive by treasury CS Henry Rotich saying that it contravened provisions of the constitution.
