The High Court has blocked the removal of Beatrice Elachi as the Nairobi County Assembly speaker.

Justice Maureen Onyango has barred MCAs and the county Public service board from appointing Elachi’s replacement and interfering with the execution of her duties pending the hearing.

“Pending the hearing and determination of this Notice of Motion, a Conservartory Order do issue prohibiting the respondents, their members or any person acting under their behest and direction, from interfering with the execution of the Petitioner of her duties current as the Nairobi City County Assembly Speaker, or otherwise howsoever debating, deliberating upon, or removing from office the Petitioner as the office of the Speaker, Nairobi City County Assembly,” reads the court papers in part.

Earlier on in the day, members of the county assembly overwhelmingly voted to impeach the embattled speaker in a special sitting convened to discuss the state of Nairobi.

In a motion by Waithaka MCA Antony Kiragu, 103 MCAs voted to oust the speaker who they said has overtime “caused the county great embarrassment.”

“Her actions and omissions have caused embarrassment and brought the office of the speaker into disrepute, this assembly resolves to sanction,” Kiragu said.

But the former nominated senator has vowed to fight her ouster as she was not accorded a chance to defend herself.

The inter partes hearing has been set for September 11, 2018 at 12 pm.
