JACQUE MARIBE AND JOE JOWIE IRUNGU IN COURT. | COURTESY

The High court will make a ruling on Jacque Maribe and Joe ‘Jowie’ Irungu’s bail application on Tuesday, October 30 at 11.30 am.

Justice James Wakiaga has asked that the accused persons be produced in court on the said date.

Prosecution lawyer Ms Mwaniki argued that the accused persons should be denied bail as they are flight risks and could interfere with potential witnesses.

Jowie’s lawyer has on his part said that the accused person has already relinquished his passport and has a place of residence in the country, contrary to popular belief.

Lawyer Katwa Kigen appearing for the Citizen TV journo argued that she has proved beyond doubt that she is a responsible individual who believes in the rule of law.

Kigen noted that the single mother of one has cooperated with the police; surrendered her phone, vehicle and has since given DNA samples.

He also asked that Maribe be allowed to resume work, something that the prosecution is against.

The prosecution has maintained that owing to her ‘celebrity’ status, Ms Maribe poses a threat to the witnesses. The prosecution wants her to stop anchoring the news.

The two took pleas afresh to include other suspects not present before the court.

On Thursday police arrested a man, Jennings Orlando, believed to have been Jowie’s accomplice. The Recce Squad officer has denied setting foot in Monica Kimani’s home in Kilimani.

In his affidavit, Jennings said that he met Jowie at a club in Kilimani only for him to later drop him off at a petrol station within the area. Irungu, he said, re-appeared at 11 pm after paying his friend from Juba a visit.

A Non-Governmental Organization,  Empowering Africa through Media, sought to participate in the case but their application rejected.

Justice Wakiaga said the NGO should file a formal application to tell the court their interest in this matter.

The prime suspect, the court was told is set to undergo surgery as a result of the alleged self-inflicted gunshot wound on his left arm.
