Alai Responds to Land Grabbing Accusations, Decries Bullying and Media Trials

Nairobi County Assembly Member Robert Alai has issued a strongly worded public statement in response to an ongoing legal dispute at the Environment and Land Court, Nairobi, where he has been named as a respondent in Case No. ELC/E229 of 2025.

The case was filed by Cancer Investments Limited, led by director Mr Ahmed Mukhtar.

In his statement, Alai accused Mr Mukhtar, his co-directors, and their legal counsel Harrison Kinyanjui of orchestrating a campaign of “trolling, defamation, bullying, and public shaming” against him, both on social media and in mainstream media platforms.

“This conduct, which has continued unabated despite the matter being active before a competent court, appears designed to prejudice the judicial process and secure favourable orders through public pressure rather than legal merit,” said Alai, who further expressed concern over what he termed an attempt to sway justice through intimidation and misuse of public platforms.

Alai alleged that Mukhtar had previously mobilized over 500 individuals to destroy property at the heart of the dispute and continues to apply pressure tactics even as the matter remains active in court. He noted that he has complied with all court orders, including a temporary injunction issued on May 19, 2025.

Citing the principles of fairness and due process, Alai warned that defamatory or bullying behaviour could expose the plaintiff and their associates to legal consequences under Kenya’s Defamation Act and the Computer Misuse and Cybercrimes Act.

“To Mr. Mukhtar, his co-directors, and their lawyer, I say this: the matter is sub judice, and your grievances must be prosecuted within the confines of the courtroom, not through media trials or social media lynching,” he said.

Alai also called on the Law Society of Kenya, under the leadership of President Faith Odhiambo, to investigate the conduct of lawyer Harrison Kinyanjui, whom he accused of professional misconduct in both the current case and a previous matter, ELC Case No. E21 of 2019.

Despite the ongoing legal battle, Alai assured Nairobi residents that the matter would not distract him from his duties. “I remain steadfast in advocating for transparency, accountability, and the protection of your rights,” he stated.

He pledged to respect the judicial process, stating that he would refrain from further public commentary while the matter is before the courts.
