    Autopsy Report Suggests Confrontation Before Lawyer Assa Nyakundi Shot Son

    A postmortem conducted by government pathologist Johansen Oduor in the presence of forensic analysts from the Directorate of Criminal Investigations (DCI), government chemists, ballistic experts, the homicide team and Assa Nyakundi’s lawyer Cliff Ombeta suggests that Joseph Nyakundi could have been shot from outside the Toyota Axio.

    Assa who is admitted at the Nairobi Hospital after developing high blood pressure complications told the police that he “accidentally” shot his son as he tried to retrieve his gun from a pouch.

    But according to the autopsy report, “whoever shot him was standing outside the rear right back door of motor vehicle.”

    This, the experts said also suggested that there was a confrontation leading up to the fatal shooting.

    “The angle of shooting according to the projection could be ninety degrees, suggesting there was a confrontation,” the report read in part.

    The report showed that the cause of death was chest injuries and hemorrhage due to gunshot from a low velocity firearm.

    Police on Tuesday repossessed over 481 bullets from Assa’s Muthaiga home during a search.

    Also recovered from his house was a Sig Sauer pistol which was found in his master bedroom as well as two empty magazines, 285 rounds of 9mm bullets, 57 rounds of 375mm bullets and 139 rounds of 12 gauge bullets.

    The Toyota Axio was also subjected to a ballistic examination and a bullet head recovered in the boot. A cartridge was also found under the mat of the front passenger seat.

    Immediately after the shooting, Assa’s eldest son, Noah said that the shooting was not an accident but murder. His Facebook post was later taken down.

    According to a relative who spoke to Nation, Noah regrets making the comment.

    “That is the tragedy of social media. It was simply an emotional reaction and Noah has since sobered up and is regretting so much about it,” the relative said.

    Joseph’s body is still at Aga Khan hospital, where he was rushed after the shooting.
