    Court Bans Sale of Samsung Galaxy S and SII in Netherlands

    A Dutch court has just ruled against Samsung in the Patent infringement suit banning “the marketing of Samsung smartphones Galaxy S, S II and Galaxy Ace for violation of Apple Inc. EP 2,058,868.”

    The full statement from Rechtrspaark reads;

    The Hague, 08/24/2011

    The judge of the court in The Hague today ruled in summary proceedings against Apple Samsung. The judge prohibited the marketing of Samsung smartphones Galaxy S, S II and Ace for violation of Apple Inc. EP 2,058,868. The judge points off debts based on EP 2098948, EP 1964022, designs, copyrights and slavish (style) imitation.

     

    Apple has infringed on three of its patents and in several of her (registered) Community Design rights and copyright in the matter of her Ipad 1 and 2 and 4 and the iPhone 3G, Apple, and finally slavish (style) imitation. The infringement committed by Samsung include tablet PCs with its Galaxy and Galaxy Tab Tab 10.1 and 10.1v and its smartphones Galaxy S, S II and Ace.

    The patents – among other things, and simply put – covers the following:

    EP 2,058,868 – method of scrolling / browsing gallery;

    EP 2098948 – recording a “flag” in connection with multiple screen taps, of which Samsung would use the system by using Android 2.3 or later version;

    EP 1,964,022 – method of “unlocking” of a portable device through the touch screen an “unlock image” in a way to drag.

    The judge will infringe on EP 2,058,868 by Samsung smartphones Galaxy S, S II and Ace (not the Galaxy tablet computers), but points off debts for EP 2098948, EP 1964022, designs, copyrights and slavish (style) imitation.Assigns ban for Netherlands against Korean companies Samsung and many European countries (including the Netherlands) against Netherlands-based companies. Exit Term until at least October 13, 2011.

    The court goes ahead and say that it ruled to “ban trading of Samsung smartphones Galaxy S, S II and Ace.” Though it finds that Samsung also violated Apple patents with the Galaxy Tab 10.1 and 10.1v,  it has not banned the sale of the tabs.
