    Court bars lawyer Letangule from defaming PS Korir over Sh2.7 billion railways land

    A magistrate stopped lawyer Thomas Letangule and his colleague Dahir Affey from defaming lands Principal Secretary Nixon Korir in relation to the sale of a Sh2.7 billion Kenya Railways land in Nairobi.

    Korir moved to court after Letangule and his law firm adversely linked him to the sale of the 93 acres.
    He claimed the sale was fraudulent.

    Aggrieved, Korir moved to court and obtained the orders on April 11 to stop the lawyer and his law firm from discussing the matter and defaming him.

    Magistrate Becky Cheloti Mulemia issued the orders and warned any disobedience or non-observance of the order of the court served will result in penal consequences on the respondent.

    “That in the interim pending the hearing and determination of the application a temporary Injunction is issued against the Defendants/Respondents whether by themselves, employees or agents restraining them from further publication of defamatory statements against the Plaintiff/Applicant herein in relation to the purported illegal acquisition of a land parcel identified as Nairobi/Block125/2173 located in Embakasi measuring 93 acres,” the order read.

    She ordered that parties file responses to the application for further directions on April 30, 2025.
    Abdulhakim Dahir Sheikh of Dahir, Affey and Associates are also named are as respondents.

    Letangule had made applications to various agencies seeking investigations into the sale of the land and adversely mentioning the PS.

    The matter has also been filed in a separate civil court.

    Letangule also named Korir in the documents saying he was leading the process of transferring the land.
    According to the petition, all key documents, including lease and offer letters, were signed in Korir’s office.

    Korir has denied the claims.

    “He was involved in the signing of a fraudulent sale agreement to justify fake transactions, enabling officials to transfer money to himself,” a letter states.

    The members of Dupoto Dafur Settlement Welfare Society through Letangule wrote to various government agencies wanting Kenya Railways Corporation (KRC) be investigated for allegedly facilitating corruption and misuse of public funds by knowingly disbursing the money to other lawyers instead of their legal representative.

    In 2024, the members filed a case in the Environment and Lands Court seeking to stop KRC and the National Land Commission (NLC) from making any payments related to the compulsory acquisition of their land.

    They argued that despite relocating with the promise of receiving their compensation, they had not been paid the remaining amount. However, they later withdrew the case.

    They argue that despite agreeing to withdraw their case, the government has failed to honor its promise.
