Court extends orders stopping arrest of Governor Wamatangi

The High Court in Nairobi extended orders stopping the Director of Public Prosecutions (DPP) and the Ethics and Anti-Corruption Commission (EACC) from arresting or prosecuting Kiambu Governor Kimani Wamatangi over alleged corruption.

Justice Chacha Mwita on Wednesday October 8, 2025 directed that the case be mentioned on December 10, 20 when further directions will be issued.

The interim orders will remain in force until then.

During the mention, lawyer Stephen Ligunya, representing Governor Wamatangi, told the court that he had filed and served the petitioner’s submissions and further affidavits dated September 30

Prosecution counsel Henry Achochi, appearing for the DPP, said his office had not received the petitioner’s documents and had therefore not filed its submissions.

EACC’s lawyer, Murugi, confirmed being served but said she had been unwell and had been unable to file her submissions.

She undertook to do so by close of business on Thursday. Ligunya did not object, saying his colleague’s condition was understandable.

Justice Mwita had earlier, on September 18, extended conservatory orders shielding the governor from any action by the DPP and EACC pending directions on the case.

At the time, the court also directed all parties to file their submissions within seven days and comply with previous case management orders.

The DPP has previously told the court that EACC was investigating companies allegedly linked to Governor Wamatangi.

Ligunya maintained that Wamatangi has no association with the firms under investigation, insisting the governor is neither a shareholder nor involved in any related case before the court.
