    Court gags Kung’u Muigai from publishing defamatory statements against Justice Lenaola

    The High Court restrained businessman Kung’u Muigai from making or publishing any further defamatory statements against Supreme Court Judge Isaac Lenaola.

    High Court judge Justice Nixon Sifuna directed that the application be served within two days, with a response expected within five days of service.

    The Applicant will be allowed to file a supplementary affidavit, if necessary, within three days after receiving the response.

    The matter will then proceed by way of written submissions, with a mention set for October 13, 2025 to give further directions.

    The court granted an interim injunction stopping Muigai, or anyone acting on his behalf, from publishing in any media or platform statements deemed defamatory against Justice Lenaola.

    The orders were issued after Justice Lenaola, through his lawyers Ngeri, Omiti & Bush Advocates LLP, filed a certificate of urgency accusing Muigai of making false, scandalous, and malicious allegations.

    According to court documents, Muigai allegedly gave video interviews on September 8 and September 12, 2025, which were later allegedly circulated on various social media platforms

    The judge accuses Muigai of linking him and other senior judges to corruption and even insinuating their involvement in the death of lawyer Kyalo Mbobu.

    “… despite a demand notice requiring him to retract the statements, Muigai continued with fresh interviews, repeating the allegations and daring Justice Lenaola to sue him,” reads court papers.

    The judge argued that such continued attacks not only injure his personal reputation but also undermine the integrity of the Judiciary, which heavily relies on public trust.

    Mbobu was shot and killed by gunmen who were riding on a motorcycle on September 9, 2025 along Magadi Road. He was Muigai’s lawyer.

    Mbobu was also the former chairman of the Political Parties Disputes Tribunal.

    The shooting is yet to be solved and police say they do not know the motive of the attack.

    No arrests have been made so far. Police have recorded statements from Muigai, several colleagues, his former clients, his family and workers as part of the probe into the fatal shooting.
