Court summons IG Kanja over Koinange land saga

The High Court in Nairobi has summoned Inspector General of Police Douglas Kanja to appear before it and explain why police officers have failed to enforce a court order protecting property belonging to the estate of the late Charles Karuga Koinange.

Justice Erick Kennedy Ogolla, sitting in the Family Division, issued the summons in Succession Cause No. 998 of 2006.

In his ruling, the judge held that the court had on November 6, 2024, issued an order safeguarding the property L.R. No. 134/8, located in Kiambu District and registered in the name of CKK Estates (1973) Limited.

The order directed police to protect the suit property from any interference or unlawful occupation.

However, Justice Ogolla observed that despite the order, the property had since been unlawfully invaded by individuals acting in defiance of the court’s directive.

The judge said that on November 7, 2024, Chief Inspector Patrick Macharia, appearing on behalf of the Kiambu County Police Commander, had assured the court that the police would comply with the orders and protect the property.

“The said suit property has been unlawfully and illegally invaded by people acting against the said court order,” Justice Okumu said.

He added that the only authority capable of guaranteeing compliance was the Inspector General himself.

“The Inspector General of the National Police Service, Mr. Douglas Kanja, is hereby ordered to appear in this court on October 9, 2025, to explain why the order issued on November 6, 2024, has not been complied with,” said Judge Ogolla.

The court further ordered that the title deeds for L.R. No. 134/8 and L.R. No. 245/4 (Njuno Farm) both registered in the name of CKK Estates (1973) Limited be deposited in court for safekeeping by October 9, 2025.
