Court Throws Out Wavinya’s Petition Against Governor Mutua

It is song and dance in Machakos after the High Court upheld Governor Alfred Mutua’s August 8 election.

Judge Aggrey Muchelule has dismissed the petition filed by Mutua’s rival, Wavinya Ndeti due to lack of sufficient evidence proving that the election was stolen.

“I find that the case was not proved beyond doubt… the allegations are not established,” the judge said as he delivered the ruling.

The former Kathiani MP through her lawyer, Willis Otieno argued that the election was marred with irregularities and called for its nullification.

But the judge said that she (Wavinya) did not make available enough evidence but relied on an ‘analysis done by Noah Akala.’

Muchelule also noted that the petitioner did not have witnesses testify in court.

He was referring to her agents who she said were chased from certain polling stations by the Governor’s people.

The former legislator has been ordered to pay Sh5 million to the incumbent and the IEBC, each.
