Interior CS Fred Matiang’i has declared October 10, formerly referred to as Moi day a public holiday following a decision by justice Odunga.
On November 8 last year, High court judge George Odunga declared that it was wrong to omit Moi day October 10 from being a National holiday.

“I hereby grant a declaration that the omission to have the 10th day of October observed as a public holiday as an illegality and in contravention of Section 2(1) as read with part 1 of the schedule to the Public Holidays Act,” Justice Odunga said.
Since the promulgation of the new constitution this day has been a normal working day yet Kenyans were already used to celebrating this day. This day was set aside in the old regime to celebrate the second president , Daniel arap Moi.
