Director of Public Prosecutions (DPP) Noordin Haji is on the spot after a Mombasa businessman accused him of threatening him with a gun during a raid at Reef Hotel two years.

According to Stephen Vicker Mangira, Haji who at the time was an intelligence officer also stole from him some Sh2 million on February 11, 2017.

Mangira told a Mombasa court that the DPP was part of a squad that raided the hotel in search of drugs. Haji and one Hamisi Salim Masha are said to have illegally conducted a search on the tycoon’s person.

“I accuse Mr Noordin Haji and Hamisi Salim Masha of jointly stealing Sh2,100,000… pointed a gun at my head and conducted a search on my person,” the court heard.

He also accused the DPP and the other officers present during the raid of falsifying the inventory of goods seized on the material day.

Haji apparently forcefully took car keys from the complainant and searched the vehicles and bags where the money was stored without a search warrant.

“After Haji forcefully took the car keys from my client he was warned not open the car as there was a lot of money in the V8 vehicle in the Hotel’s car park,” lawyer Kamunde submitted.

The city tycoon sued the DPP for malicious prosecution and through his lawyer Kinyua Kamunde sought to have Haji blocked from prosecuting the case due to conflict of interest.

His application was however rejected by the Attorney General because the DPP and the head of the anti-narcotics unit (Masa) cannot be sued in their personal capacities for acts performed during their stints as state officers.

The businessman was charged with money laundering alongside a Tanzanian, Nabil Loo Mohamed.
