Governor Obado Back In Remand, Court To Make Bail Ruling On Thursday

Governor Obado set to spend more nights in prison after  Justice Lesiit said that she will make a ruling on the bail application on Thursday 27 at 2p.m.

The prosecution argued that the governors release would cause public discomfort especially in Migori county as there would be a clash between his supporters and non supporters. They refuted claims by the defense that failure to award him bail would be against his inalienable rights set under article 25 of the constitution.

The defense argued that the Migori governor should be given bail  given that the state did not have compelling reasons to hold the accused person for any longer. The asked justice Lesiit to invoke her discretion and grant him bail.

They asked the court to ignore an affidavit filed by the investigation officer that they said had mundane reasons as to why he should be held longer. Lawyer Cliff Ombeta tore down the affidavit by the  saying that they failed to show the level of influence  and how it would affect the case.

He said that the family said that they had been threatened but there was no complaint lodged by any specific person.
