Kenya Power managers arrested on Friday have been released on a Sh1 million cash bail each.

The directors, including suspended Managing Director Dr Ken Tarus, his predecessor Ben Chumo and eight others spent the night in remand at Gigiri Police Station after they denied charges of impropriety in acquisition of faulty transformers and irregular award of transport and labour contracts.

Lawyer Tom Ojienda, representing Chumo, on Monday told the court that bail is a constitutional right and that they should be freed pending trial.

But the prosecutor Jacinta Nyamosi asked the court to deny the suspects bail as they were potential flight risks and could interfere with ongoing investigations.

“No material has been placed in this court to show that any of the accused persons is a flight risk. What the prosecution are giving are general statements,” Ojienda argued.

The prosecution also asked chief magistrate Douglas Ogoti to consider the fact that all the suspects are influential people in society and the chances of their accessing files at the Kenya Power offices are high.

The defense lawyers did however accuse the state of violating the accused persons’ rights.

The pre-trial Chief Magistrate Ogoti has ruled will be held on August 6.
