The court said that this payment should be personal and should be deducted from their salary of the next month. Justice Odunga said that the court cannot declare the three officers unfit to hold office as that would be a matter for another forum.

The judge also declared that the orders that were made by Justice Luka Kimaru were still valid and the three were still to facilitate the provision of a valise passport.

This ruling comes after the three had failed to appear in court and also failed to produce Miguna in court and instead they deported him. A visibly angry Justice Odunga said that court orders were not suggestions which the three should catwalk on.
