MP Kibagendi arrested in Nairobi over assault claims, to take plea in Kisii

Kitutu Chache South MP Anthony Kibagendi was Tuesday arrested in Nairobi over assault claims on a reveler in Kisii Town last year.

Kibagendi was stopped at a traffic jam along Uhuru Highway and forced out of his car by detectives from the Directorate of Criminal Investigations.

He was driven and booked at Muthaiga police station pending his transfer to Kisii for plea taking on Wednesday.

Police said their move came after the Office of Public Prosecutions approved assault charges against the MP.

This was in regard to an incident he confronted one Enock Omariba in a restaurant last year in Kisii Town.

Their encounter quickly escalated into a physical altercation as tensions flared between the two, drawing the attention of bystanders who moved to intervene and separate the parties involved.

Kibagendi is accused of assaulting Omariba on November 27, 2025.

According to Omariba, the lawmaker, who was accompanied by his bodyguard, stormed the restaurant while he was having breakfast with a lawyer friend and attacked him, leaving him badly injured on his left leg.

CCTV footage that went viral showed Kibagendi getting into the restaurant a few minutes before 9am before he pounced, kicking and raining blows on the complainant as two customers and hotel staff tried to separate them.

The footage also shows Kibagendi shoving a customer who intervened before he was finally whisked away.

The matter was reported to Kisii Central Police Station.

Kibagendi had obtained an anticipatory bail of Sh50,000. But police said it did not stop them from arresting and arraigning him.

Lady Justice Teresa Achieng’ Odera of Kisii granted the MP a Sh50,000 anticipatory bail, prohibiting police from arresting him pending further directions.

The orders were issued on December 2, 2025, following an application filed through Bonuke and Company Advocates.

Kibagendi is a supporter of former Cabinet Secretary Fred Matiangi in his bid for president.
