Nine in illegal occupation of Supkem land arraigned, released on bail
A Nairobi Chief Magistrate Court released nine representatives linked to Huruma Mosque on cash bail after they were charged over an alleged Sh15.1 million land dispute involving the Supreme Council of Kenya Muslims (SUPKEM).
The nine Said Dorfa Akare, Mohamed Godana Kalicha, Jillo Gone Jillo, Molu Sora Bonaya, Adan oge Abdullahi, Ali Kibarabara Said, Noor Salim Nzioka, Hussein Mohamed Jillo and Mohamed Said, appeared before Milimani Chief Magistrate Geoffrey Onsarigo and denied a charge of forcible detainer contrary to Section 91 of the Penal Code.
According to the charge sheet, the accused allegedly remained in possession of parcel Nairobi Block 130/1650 (L.R. No. 209/10509) in Huruma, Nairobi, between May 2025 and September 15, 2026, despite allegedly having no legal right to occupy the property.
The prosecution told the court that the disputed land is registered in the name of the Supreme Council of Kenya Muslims Registered Trustees (SUPKEM), which is the complainant in the case.
During the proceedings, defence lawyers Danstan Omari and Stanley Kinyanjui urged the court to defer the taking of plea and refer the matter back to the Office of the Director of Public Prosecutions (ODPP) to allow parties to pursue an out-of-court settlement.
Omari argued that the dispute concerned a mosque and members of the Muslim faith, adding that religious institutions should be resolved through mediation in the public interest rather than criminal proceedings.
The prosecution opposed the application, saying the ODPP had reviewed the investigation file and found sufficient grounds to institute criminal charges.
Counsel appearing for the complainant also supported the State’s position.
Chief Magistrate Onsarigo rejected the request, directed that the accused take plea, and released each of them on a cash bail of Sh50,000 with two sureties or an alternative bond of Sh200,000.
The matter will be mentioned on September 30, for further directions.
