    PCEA officials to be sentenced on December 18 after being guilty of contempt of court

    The High Court set aside December 18, 2025 as the day two top PCEA officials will be sentenced after they have been found guilty of contempt.

    The two will face jail or pay a fine depending on the sentencing g by Lady Justice Stella Mutuku.
    On Monday, the PCEA Moderator Dr Rev Thegu Mutahi asked the court for leniency and forgiveness during mitigation.

    Rev. Mutahi will be sentenced together with the Secretary General of the General Assembly Dr Rev Robert Wiahenya who will take the dock in mitigation before the sentencing on Thursday.

    The two had been found guilty of contempt after they installed David Nderitu Ndumo as Honorary Treasurer despite being served with an injunction prohibiting them from doing so in April 2024.

    At the time, Ndumo was facing a Court case by 15 guarantors after failing to pay an initial Sh5.3 million loan he had secured from Sheria SACCO. The amount has since soared to Sh8.4 million after accruing interest and other charges.

    The court was persuaded to adjourn the sentencing after the Secretary General Waihenya through his lawyer asked for the court to move the proceedings to 2.30pm as opposed to the earlier scheduled 11.30 am today.

    But counsel for the Moderator excused himself explaining he would be committed in the afternoon as he had a scheduled teaching lesson.

    All agreed to be available on Thursday.

    “I do not want to do two different sentences but one for both. So, we will have the court adjourn to Thursday at 12 noon for the second mitigation and sentencing,” ordered Justice Mutuku.

    In mitigation, the Moderator Rev Mutahi expressed remorse and pleaded for leniency saying he was a first offender.

    “The First Respondent has agreed to abide by the Law in its rulings and is ready to teach the Church about the Law especially the importance of its orders,” said Rev. Mutahi’s lawyer Prof Njaramba Gichuki whose client sat expensively in the court together with David Nderitu Ndumo.

    The court had found the two guilty of contempt of court after it was established they were properly served by the process server.
