‘The Petition Before Us Was Simple But the IEBC Fumbled’ Chief Justice Maraga

Chief justice Maraga has said that the case would not have changed even if heard in different Jurisdictions.He said that the case was simple but the IEBC fumbled it.

The  chief Justice said that despite calls to subvert and ignore the constitution they would not partisan to that.

The Chief Justice while dealing with matters of illegality before the election date avers that The petitioner failed to provide evidence that the third respondent used government machinery to campaign.

The court noted that the evidence presented was inconclusive and not presented in the required manner.

“We cannot afford to lock our eyes to the President who had no benefit to bring his thoughts into this. Let the matter be addressed in the right proceedings,” chief Justice Maraga said.

The Supreme court was left asking a lot of questions with regards to the various irregularities that were committed by IEBC officials, some of the questions that arose were;

 

The president of the supreme court stated that while it was important to consider the popular vote it was equally important to observe the purity of the process.

The Chief Justice advised the IEBC to put in place a complimentary system when conducting the fresh elections.

Chief Justice Maraga said that whether it was about numbers or the law elections must reflect the true will of the people.
