Former Kiambu Governor Ferdinand Waititu Babayo will remain in custody after the High Court dismissed his latest attempt to secure bail pending appeal after filing a fresh application.
Waititu is serving a 12-year sentence at Kamiti Maximum Prison following his February 2025 conviction by the Nairobi Anti-Corruption Court.
The prosecution argued that Waititu’s application was res judicata since the court had already determined the issue on bail pending appeal on 3rd March 2025.
Nairobi Anti-Corruption High Court Justice Lucy Njuguna dismissed the application, terming it devoid of merit.
The High Court further issued directions on the appeal, directing parties to file submissions.
The case is scheduled for mention again on June 18, 2025, to confirm compliance.
The former governor was sentenced to 12 years in prison or pay Sh52.5 million after he was found guilty of conflict of interest in a Sh588 million graft case.
Waititu was similarly barred from vying for any political seat for a period of seven years.
Waititu was charged along with his wife, Susan Ndung’u, who was slapped with a one-year imprisonment or pay a fine of Sh500,000.
He has since been moved from Industrial Area prisons to Kamiti Maximum Prison. This was after an undisclosed person accused him of sending him a message deemed threatening while at Industrial Area.
