    IEBC Move To the Court Of Appeal to Appeal The Decision By Justice Odunga

    IEBCIEBC has gone to the court of appeal to appeal a high court decision by Justice Odunga who declared the appointment of the returning officers and the presiding officers as illegal.

    He said that the appointment was a contravention of the election regulations  and specifically regulation 3 which states that the appointments of the 290 returning officers must be  in consultation with the political parties.

    The IEBC failed to do this for the fresh elections and gazetted the officials without the parties consultations.

    IEBC senior counsel Paul Muite said that this illegality may be fixed within the day as it was just a matter of the commission presenting the list of the election officials to political parties  for approval and that if the ones identified were not good enough as per the political parties would be replaced.
