The Employment and Labour Relations court has blocked Kenya Airways (KQ) from replacing the 131 technical staff dismissed last week following an ‘illegal’ industrial action.

The staff had gone on a go slow last week over 840 per cent pay increase. Some said their salaries are much less than what they were promised, they wanted at least Sh340,000 for technical assistants and Sh1.2 million on the higher side.

But Judge Hellen Wasilwa issued a restraining order stopping the national carrier from replacing the staff until the matter was heard and determined by the court.

”An order is hereby issued restraining Kenya Airways from replacing the technical staff,” the judge said.

Lawyer Dismas Wambola, on behalf of the staff argued that the KQ management dismissed those on lawful leave and off duty together with those on a go slow.

”Some of the workers were either on lawful leave or off duty on November 28, and have not been issued with dismissal letters, but they have similar grievances as those already dismissed, and are reasonably apprehensive that Kenya Airways will soon issue them with dismissal letters,” Wambola said.

He said that the workers were wrongfully, unlawfully dismissed and were not given a chance to air their grievances.

”The claimants have only been agitating for better remuneration, which is a right of every employee and is protected by the law and the constitution,” the lawyer continued.

The case will be heard on December, 18.
