County assemblies that are found to have funded the People’s assemblies activities will be ‘surcharged,’ Attorney General Githu Muigai has said.
He has warned county assemblies that have adopted the motion against funding the ‘treasonable’ act the NASA coalition plans on undertaking on December 12.
The government’s legal adviser noted that the People’s assembly is not recognized by the constitution hence rendering its activities ‘illegal, unconstitutional, null and void.’
Should officers in the 12 counties fund their activities, then they will be misappropriating public funds, undermining the rule of law and acting in contempt of court.
Muigai also noted that the government had not received notification of any alternative swearing in which he says is an act of high treason, punishable by death.
The criminal law of the Republic of Kenya stipulates that this sort of process is high treason. It is high treason of the persons involved and any other person facilitating that process,” he said.
He also said that the NASA leader’s (Raila Odinga) swearing in would be null and void without the presence of the Chief Justice who presides over the ceremony.
Also present was government spokesperson, Eric Kiraithe who said that the state was open to dialogue with those in the opposition who feel aggrieved but will not allow ‘banditry politics.’

Odinga has maintained that he will be lawfully sworn in as the people’s president and will not recognize the legitimacy of the Jubilee government.
He on Thursday told off the US administration that has warned against further polarising the country, saying that they should not interfere in Kenya’s internal affairs.
“We don’t recognize the swearing-in. We will go by the results of August 8 elections in which Kenyans expressed their will. We will not be intimidated…our friends can advise us but they should not shout at us about violating of the constitution…constitution my foot,” the former Premier said.
