    Petitioner Wants Justice Mativo Removed From Office, Accuses Him Of ‘Copy Pasting’ Ruling

    High Court judge, Justice John Mativo was on Wednesday accused of gross misconduct, with a petitioner seeking for his removal from office.

    The petitioner, Adrian Kamotho Njenga while submitting his petition with the Judicial Service Commission (JSC) said that the judge was in contravention of articles 73, 74 and 75 of the Constitution.

    Mr Njenga said that Justice Mativo hastily delivered a judgement which he says was an ‘outright copy paste’ of another case determined by the Nyeri High Court in February, 2016.

    Mativo was accused of not giving a detailed explanation for his expedited ruling that was set for October 18 but was given on September 27, 2017.

    ”Justice John Mativo has failed to uphold the dignity and the respect for the Judiciary and the judicial system of Kenya. The plagiarism committed by the judge is the most scandalous form of judicial and intellectual dishonesty,” the petition said.

    The Judge in October ruled that Third Way Alliance presidential candidate and other candidates running during the August 8 elections be included in the October 26 repeat polls.

    Justice Mativo ruled the Supreme Court acted beyond its mandate by purporting to interpret the Constitution on fresh elections, putting the opposition leaders who had withdrawn from the race in a tight corner.
