    Confrontation Looms As Government Refuses To Facilitate Miguna’s Return

    The Immigration Department will not allow deported lawyer, Miguna Miguna into the country on Wednesday, Immigration Principal Secretary Gordon Kihalangwa has said.

    In a letter responding to Kenya National Commission on Human Rights (KNCHR) Vice Chairperson George Morara, Kihalangwa says that Miguna is yet to apply for a fresh Kenyan passport through the right channels.

    “Without any prejudice, we reiterate that Miguna has to regain his Kenyan citizenship before being issued with a Kenyan passport,” the letter dated 10 May reads in part.

    The PS further stated that the state was not going purchase an air ticket for the self declared NRM general. He did however mention that the department would allow him back into the country if he used his Canadian passport.

    On whether the department would allow KNCHR officials into Jomo Kenyatta International Airport (JKIA) to monitor Miguna’s entry into the country, the PS says that only Kenya Airports Authority (KAA) could grant them entry.

    “Court orders were clear that Miguna should be facilitated and that to us means he should be given his passport and secondly the State should provide him with a ticket because Miguna did not remove himself from this jurisdiction,” Morara countered.

    The international lawyer was deported for the second time on March 29 aboard an Emirates Flight EK 722.

    His lawyers among them James Orengo, Nelson Havi, Cliff Ombeta and Julie Soweto were roughed up by security officers as they tried to serve immigration officers with court orders.

    Justice George Odunga had earlier on in the day charged Interior CS Fred Matiang’i, Inspector General of Police Joseph Boinnet and Kihalangwa with contempt of court.

    “State officers cannot continue to act in contempt, going on with their own businesses while cat-walking on courts’ orders. The three are hereby convicted accordingly and should appear before this court tomorrow at 10am.”

    The trio was later released and fined Sh 200,000 each.
