The Milimani High Court Tuesday declined to vacate a warrant of arrest issued against one of the police officers charged with the murder of the Kianjokoma brothers.

James Mwaniki, through his advocate, wanted the court to lift a warrant of arrest issued Monday after he failed to attend court.

The court directed that James Mwaniki appear before it after being discharged from the hospital.

The court, through the Deputy Registrar has confirmed that Mwaniki, one of the accused persons in the case, has been admitted to Thika Level 5 Hospital since June 8, 2025.

Mwaniki and five others, including Benson Mbuthia, Consolata Kariuki, Nicholas Cheruiyot, Martin Wanyama, and Lilian Cherono, were accused of murdering two brothers, Benson Njiru and Emmanuel Mutura, in Kianjokoma, Embu County, in August 2021 while enforcing curfew rules.

The witnesses that had been anticipated to testify this week were the government pathologist, two civilians, and a few police officers.

The court had set a five-day hearing on the matter before adjourning it after one of the accused was hospitalized.

The prosecution has lined up several witnesses to testify in the case.

The case will be mentioned on  July 2, 2025.
