A Milimani Chief Magistrate’s court released a man accused of posing as a Kenya Defence Forces (KDF) Brigadier was on charged with obtaining money by false pretenses on bail.

Joshua Mutui Maingi, also known as “Brigadier Muimi,” is alleged to have defrauded Brenda Otieno of Sh610,000 on October 21, in the Kilimani area, Nairobi.

According to the charge sheet, Maingi, jointly with others not before the court, falsely claimed he could secure KDF recruitment slots for the complainant’s relatives, claims the prosecution says he knew were untrue.

The prosecution told the court that although the accused is facing another similar case, the complainants in the two matters are different.

However, the defence argued that the circumstances in both cases are closely related, arguing that the earlier matter had been mentioned before the same court a day earlier and is scheduled for mention on December 16, 2025.

Maingi’s lawyer pleaded for lenient bail terms, saying the accused is a family man with a wife and two children who depend on him.

Chief Magistrate Dolphins Alego also heard that he has a fixed residence in Utawala, owns a company where he works daily, and suffers from diabetes.

The defence further alleged that Maingi had been granted bail in the previous case and had consistently attended court without absconding.

The prosecution did not oppose bail.

The court released Maingi on a bond of Sh500,000 or an alternative cash bail of Sh100,000.

The matter will be mentioned on January 12, 2026, for pre-trial.
