Nandi Senator Kiprotich Cherarkey has tabled a motion in the Senate seeking the withdrawal or reduction of retirement benefits and allowances allocated to former President Uhuru Kenyatta.
In the motion presented on Monday, May 4, 2026, Cherarkey argues that Section 6 of the Presidential Retirement Benefits Act restricts retired presidents from engaging in active partisan politics beyond a specified period. He noted that the law envisions a neutral, advisory and consultative role for former heads of state for the benefit of the nation.
The senator claimed that Kenyatta has, since leaving office, been publicly associated with partisan political activities. These include attending and addressing political rallies, issuing statements perceived to support or oppose political actors, and participating in mobilisation efforts linked to ongoing political contests.
According to Cherarkey, such actions undermine both the spirit and intent of the law, raising questions about the justification for continued enjoyment of taxpayer-funded retirement benefits.
He is now urging the Senate to consider withdrawing or reducing the benefits in line with Section 4 of the Act.
The motion also calls on the Office of the Auditor-General, working with relevant state agencies, to conduct a comprehensive audit of all public resources allocated to the former president.
“This House recommends the revocation, variation, or reallocation of the budgetary provisions relating to the benefits of the retired president, in line with the findings of the audit and subject to approval in accordance with the law,” Cherarkey stated.
He further proposed that any funds recovered from previously allocated benefits be redirected towards public welfare programmes.
