The court of appeal has nullified the election of Embakasi South member of parliament Julius Mawathe who won on a wiper ticket an affiliate of the NASA coalition.

The election was contested by former MP and ODM candidate Irshad Sumra. The former MP had blamed the returning officer whom he claimed mixed the results. He said that he declared the looser the winner

The court of appeal agreed that there was a mix up in the results at Embakasi girls Secondary school polling station. The High court had upheld Julius Mawathe’s win saying that Sumra had failed to provide sufficient evidence.

Julius Mawathe was declared the winner of the poll after IEBC said he garnered 33,880 against Irshad Sumra’s 33,708 votes.
