    High Court Suspends Proposed Taxes In Finance Bill 2018

    Activist Okiya Omtata is a happy man after the High Court suspended the imposition of taxes proposed in the Finance Bill 2018 pending determination of the petition.

    The Activist filed a petition to stop the implementation of the new bill citing that it did not follow due procedures. The Treasury Cabinet Secretary Henry Rotich, the Commissioner General Kenya Revenue Authority, the National Assembly and the Attorney-General were listed as respondents.

    Justice Wilfrida Okwany determined that Activist Okiya Omtata provided sufficient evidence to support the petition hence she chose to suspend the taxes in case the bill is found unconstitutional.

    “If on the other hand the court finds its unconstitutional there will be no practical way of compensating the Kenyans payers who have been affected by the said Bill,” ruled Justice Okwany.

    Okiya Omtata had previously argued that the law stipulates that all bills must go through the legislative process and public participation before they become law.
