    Agency Wants Government to Seize Ngirita Family Cars and Lands

    Assets Recovery Agency now wants property owned the National Youth Service (NYS) scandal key suspects, the Ngirita family forfeited to the government.

    In an application heard in court, the agency wants the properties of Phyllis Ngirita, Lucy Ngirita and Jeremiah Ngirita declared as proceeds of an economic crime.

    “It is in the interest of justice that court issues an order that the said assets belonging to the three and which are reasonably believed to be proceeds of crime be forfeited to government and transferred to ARA,” reads part of the court papers.

    The properties to be forfeited are five parcels of land and three vehicles belonging to the three members of the family.

    That includes a parcel of land in Waitaluk in Kitale measuring 0.70 hectares, another in Naivasha town, which was sold to Mrs Ngirita by New Hope for All Nations on July 8, 2016 and another one in Nakuru East measuring an acre which she acquired on April 25, 2017.

    Also to be taken away are two Toyota station wagons and a pick-up registered in the names of Opportunity International Wedco Limited and Platinum Credit.

    The affidavit further claimed that among other suspects, the three were charged with criminal offence and that preliminary investigations established that they received large amounts of monies to their personal accounts.

    “Upon investigating the bank statements and documents concerning the accounts, the agency established that the three and their business entities and associates received funds fraudulently from NYS split in several transactions,” the affidavit states.

    The agency further argued: “Investigations revealed that Phyllis was paid by NYS directly to her personal account contrary to procedure. This is a clear case of fraud as there is no evidence of goods or services procured by NYS directly from Phyllis.”

    Following the application, Judge John Onyiego instructed that the application be served to the Ngiritas within 24 days, during which they are to file their response.

    The case was set for mentioning on April 15, 2019.

    ARA also filed a similar application against James Thuita Nderitu, Flagstone Merchants Limited, Firstling Supplies, Excella Supplies Limited, Betty Omondi, Flagstone Co. ltd and Interscope Tech. Services.
