A High Court in Nairobi has ordered that movable property of AFC Leopards be attached for failing to pay Ksh33 million fine for breach of contract with Nsejjere Sports LLC.

The US firm sued the former Kenyan Premier League giants in 2015 for breach of a seven-year kitting deal and were awarded Ksh22 million in damages last year February.

The amount has since accrued interests and the court has given greenlight to the creditor’s auctioneers to attach Ingwe’s property for possible auction or transfer.

“These are to command you to attach the movable property of the said J/Debtor,” the warrant of attachment reads partly.

Leopards’ past officials including Allan Kasavuli, Patrick Ngaira (vice chairman), George Aladwa (secretary general), Esther Luvembe (acting treasurer) and Timothy Lilumbi (organizing secretary) had also been listed as defendants.

In their suit Nsejjere Sports had asked the court to stop AFC Leopards from using, selling or merchandising replica jerseys, T-shirts and caps that have not been supplied by the firm as their contract was still in place.

They claimed Leopards officials declined to accept a consignment of kits and other merchandise it shipped to Kenya in 2014 and had signed a similar deal with another kitting firm.

Nsejjere wanted Leopards compelled to honor their contract or be ordered to pay damages for breach of contract which the court granted.
