The High Court on Wednesday declared section 84D of Kenya Information and Communication Act (KICA) unconstitutional in a petition filed by blogger Cyprian Nyakundi. The section criminalized sharing vulgar information online. The court found that the section is vague and limits freedom of expression. Kiambu Governor Ferdinand Waititu has appealed against the Sh15 million bail set on Tuesday by Chief Magistrate Lawrence Mugambi. According to the governor, his wife Susan Ndung’u’s Sh4 million bail was also excessive. Waititu and his wife were alternatively supposed to post bonds of Sh30 million and Sh10 million respectively. Kiambu Governor Ferdinand Waititu, his wife Susan Ndung’u and six other co-accused persons will spend another night in custody pending the bail ruling. Appearing before Magistrate Lawrence Mugambi on Monday, the accused persons all involved in the loss of Sh588 million denied multiple corruption-related charges leveled against them by the prosecution.
