Company asks IG to intervene in Thika land dispute after years of occupation

Floriculture International Limited has appealed to the Inspector General of Police to intervene in a long-running land dispute in Thika, alleging that Central Kenya Limited continues to occupy its property despite a High Court judgment dismissing a challenge to its ownership.

In a letter dated October 9, 2026, the company asked the National Police Service to investigate alleged trespass and forcible detainer on Land Reference Number 7705/2 in Thika Municipality and facilitate its recovery of vacant possession in accordance with the law.

Floriculture says Central Kenya Limited has refused to vacate the property despite a February 14, 2020 judgment by Justice Francis Tuiyott, which dismissed the company’s suit challenging the charges, sale and subsequent transfer of the land.

The company added it had served four orders to the Kiambu County security team but all the efforts have been watered down by a member of the team who has interests.

The dispute dates back to June 1993, when charges were registered over the property in favour of Trust Bank Limited and Trust Finance Limited to secure facilities of Sh15 million and Sh30 million, respectively, advanced to Katka Islands Limited.

Following default on the facilities, the lenders exercised their statutory power of sale, and the property was subsequently transferred to Floriculture International Limited in May 1995.

Central Kenya challenged the transaction in Nairobi High Court Civil Suit Number 3590 of 1995, alleging irregularities in the charges, sale and transfer.

However, in his 2020 judgment, Justice Tuiyott dismissed the suit, finding that Central Kenya had failed to prove its case. The court also held that the lenders were entitled to exercise their statutory powers of sale following the default.

Floriculture now argues that the judgment affirmed its ownership and entitles it to possession and quiet enjoyment of the property.

In its letter to the police, the company alleges that Central Kenya has continued occupying the land and filing fresh suits raising issues it says have already been determined by the courts.

The company wants police commanders in Kiambu County and Thika to investigate the alleged trespass, record statements from the parties and take appropriate action, including recommending criminal charges to the Office of the Director of Public Prosecutions where warranted.

It has also requested security during the lawful recovery of possession and measures to prevent further entry, construction, cultivation or removal of property from the disputed land.

The company said any enforcement must comply with the relevant provisions of the Land Act governing unlawful occupation and eviction.

The police have been asked to provide written confirmation of the steps taken within 14 days.

In a ruling delivered on October 5, 2026, the tribunal, presided over by Joyce Osodo, ordered Peter Mwangi and Charity Wanjiku Muiruri to hand over vacant possession of premises identified as Block 8/264, previously known as Land Reference Number 7705, Thika Municipality, to Floriculture International Limited.

The tribunal directed the Officer Commanding Station at Ngojiwa Police Station to enforce the vacant-possession orders.

The two respondents were also ordered to pay costs of Sh25,000 shillings.

The matter was filed as Business Premises Rent Tribunal Case Number BPRT/E1109/2026.

The tribunal ruling is among the latest developments in the dispute over the land.

Earlier on March 23, 2026 the Environment and Land Court in Thika, struck out a constitutional petition seeking to revisit ownership of the property.

The court found that the petition was res judicata, meaning the issues had already been determined, and amounted to an abuse of the court process.

It also discharged conservatory orders issued on October 30, 2025, and awarded costs to the third respondent/applicant.

In its ruling, the court held that it could not sit on appeal or review of a decision by a court of equal status, particularly as the dispute was also the subject of a pending appeal before the Court of Appeal.

Floriculture says it has pursued legal avenues for years and is now seeking police intervention to secure possession of the property while the outstanding appeal proceeds through the courts.

“We have shown patience for many years and have pursued every lawful avenue available to us. We will not allow our property to remain hostage to a party whose claims the High Court has rejected. Should this letter not receive the urgent attention it deserves, we shall, without further reference to you, pursue all remedies available to us, including proceedings to compel the protection of our rights under Articles 40 and 244 of the Constitution,” read the letter.
