The High Court on Monday dismissed a case seeking to bar the Independent Electoral Boundaries Commission (IEBC) commissioners from conducting the October 26 presidential polls.

Justice John Mativo while delivering the ruling said that the ‘case lacked legal basis, unmerited and the orders sought cannot be issued.’

“In view of my determination of the above issues and finding that the petition is unmerited, I find that there is no legal basis for the court to grant the reliefs sought,” Justice Mativo said.

The body’s commissioners have been accused of bungling the August 8 presidential election hence the Supreme Court nullifying it.

Chairman Wafula Chebukati in remedying the situation, on Friday set up a seven member team that will oversee the repeat polls.

He locked out CEO Ezra Chiloba, Nancy Kariuki and Silas Rotich.
