    Ekuru Aukot Petitions IG to Release Dangote Refinery Contract and Ownership Details

    Thirdway Alliance Kenya party leader Ekuru Aukot has petitioned the Inspector General of Police (IG) to release details of an agreement between the Kenyan government and Dangote East Africa Petroleum Refinery and Petrochemicals SEZ, including information on its shareholders and beneficial owners.

    In a letter dated October 2, 2026, Aukot demanded full access to the contract or agreement executed between the Government of Kenya, or any associated public entity, and the Dangote Group or its project entity, Dangote Refineries Limited SEZ, concerning the proposed Dangote East Africa Refinery and Petrochemicals SEZ in Lamu.

    Aukot said his request covers all execution copies, schedules, side letters and subsequent amendments relating to the agreement.

    He also asked the government to clarify the status of the project if a definitive agreement has not yet been executed and provide any existing draft agreements and approvals on record with the Attorney-General.

    Aukot said the request was prompted by recent public statements by President William Ruto dismissing calls for greater accountability over the project.

    He cited remarks in which citizens raising questions about the project were allegedly referred to as “matapeli” and accused of attempting to extort the investor.

    Aukot rejected the characterization, arguing that citizens have a constitutional right to access information concerning public contracts.

    “Seeking access to public government contracts is an inalienable constitutional right under Article 35,” Aukot said.

    He added that while foreign investment that advances Kenya’s interests was welcome, citizens were entitled to scrutinise contractual commitments entered into on their behalf.

    Aukot also wants clarification on whether the agreement or project was presented to Parliament for consideration, debate, approval or ratification.

    “We further request you to confirm whether the agreement or project was laid before, debated, approved or ratified by Parliament,” he said.

    He requested copies of the relevant Hansard records, committee reports, resolutions and approval documents if Parliament considered the project.

    If the project was not presented to Parliament, Aukot wants the government to explain whether parliamentary approval is considered necessary and provide the legal basis for its position.

    He also wants clarification on whether the project is being treated as a public-private partnership and whether it creates any public financial liability.

    The Thirdway Alliance leader further demanded documents detailing the ownership and management structure of Dangote East Africa Refinery and Petrochemicals SEZ.

    Among the documents he is seeking is a copy of the contract between the Government of Kenya and Dangote East Africa Refinery and Petrochemicals SEZ.

    He also wants a list of all beneficial owners of the company, details of its current directors and official CR12 documents for all locally incorporated corporate shareholders.

    For foreign corporate shareholders, Aukot is seeking corresponding registry documents showing the ownership structure of the entities.

    He is also demanding copies of the Memorandum and Articles of Association, or equivalent documents, for all local and foreign corporate shareholders, as well as details of the beneficial owners of those shareholders.

    Aukot said the information would help establish the full ownership structure of the project entity and provide clarity on the parties involved in the investment.

    Aukot warned that Thirdway Alliance Kenya would pursue legal action if it establishes that the government unlawfully withheld the requested information.

    “If the evidence establishes that President Ruto personally directed or maintained an unlawful refusal, Thirdway Alliance Kenya shall immediately commence proceedings against the state now and against him personally after he leaves office,” Aukot said.

    The petition comes amid growing public interest in the proposed Dangote investment and questions surrounding the terms of any agreements between the Kenyan government and the Nigerian business group.

    Nairobi Senator Edwin Sifuna is also on record demanding the release of the agreement.

    However, President Ruto said yesterday that releasing the contract may lead to extortion, but asked Sifuna to use Parliament to access it.
