Two Appellate judges have withdrawn from Martha Karua’s petition challenging election of Kirinyaga Governor Anne Waiguru.
Justices Fatuma Sichale and Sankale Ole Kantai recused themselves because they are close with the Karua who is seeking to overturn the High Court’s decision to uphold Ms Waiguru’s election.
Justice Sichale informed the presiding judge William Ouko of her close ties with Ms Karua saying that she has known the former since their days at the Federation of Women Lawyers-Kenya.
Justice Kantai on his part said he has known the Narc-Kenya party leader since she was practicing as an advocate and became close allies when she was Minister Justice and Constitutional Affairs Mwai Kibaki’s government.
The two judges argued that their presence would create a perception of bias.
