MachakosThe petition of Wavinya Ndeti hangs on the balance after a lawyer testified that he did not commission the affidavits that were presented to the court.

The fact that the affidavits were not commissioned is an indication of an illegality making the affidavits inadmissible in a court of law. Wavinya Ndeti had petitioned against the win of Alfred Mutua as Machakos governor.

This comes as a win for Alfred Mutua whose lawyers had failed to show up during a previous court session. The court had also ordered that all the materials that had been used during the elections to be re- examined.

Wavinya Ndeti said that governor Mutua’s win was not genuine and that he was also a ‘computer generated’ leader.
