The New York City Bar Association has written a letter to President Uhuru Kenyatta warning him against the recent attacks on the Judiciary following the nullification of his August 8 win.

John S. Kiernan, President of the ‘Association’ put across his sentiments pertaining to Kenyatta’s attack on the said arm of Government.

”Intimidation of the Judiciary subverts the democratic gains consolidated by the decision, we urge the government of Kenya to continue to respect the independence of the Judiciary as provided in the Constitution of Kenya, the African Charter on Democracy, Elections and Governance and the United Nations Basic Principles on the Independence of the Judiciary,” reads the statement in part.

He noted that the historic judgement made on September 1 would positively impact on the country’s rule of law for years to come.

In the letter, Mr Kiernan made reference to Senate Majority Leader, Kipchumba Murkomen’s remarks where he referred to the Law Society of Kenya (LSK) as a ‘political monolith,’ accusing them of working for the political opposition.

The LSK and the Kenya Judges and Magistrates Association had condemned the President’s attacks against the Judiciary.

The Association, made up of 24,000 lawyers from the US and over 50 countries did however laud the President for calling on Kenyans to respect the rule of Law although he ‘disagreed with the ruling.’
