A man was arraigned before Senior Resident Magistrate Stephany Bett at the Makadara Law Courts over alleged inflammatory remarks targeting Burundian nationals living and working in Kenya.
Kevin Odiwuor Otieno, also known as “Engineer Kevin”, was arrested by officers from the Directorate of Criminal Investigations (DCI), Buruburu, following the circulation of a video online in which he allegedly made inciting remarks during a Bunge la Mwananchi gathering at Jacaranda Grounds on 6th September 2026.
The remarks allegedly sought to stir feelings of contempt, hatred and hostility, and incite violence against Burundian nationals in Kenya.
Otieno was charged with three counts of ethnic contempt, hate speech and offensive conduct likely to cause a breach of the peace.
He pleaded not guilty to all the charges.
Principal Prosecution Counsels Alex Gituma and Maureen Mwenesa did not oppose the accused’s release on bail or bond but urged the court to take into account the seriousness of the allegations.
The court granted Otieno a bond of Sh300,000 or a cash bail of Sh150,000.

The developments come amid ongoing controversy surrounding an order by president William Ruto to remove foreigners engaged in small scale businesses.
The foreigners have been granted 90 days to regularise their documents.
Meanwhile, the prosecution secured a 50-year prison sentence against Rachael Akinyi Juma for trafficking five kilograms of cannabis sativa (bhang) in Kakamega.
Juma was sentenced to 50 years in prison or, in the alternative, pay a fine of Sh50 million after the court found her guilty of trafficking narcotic drugs.
The court heard that on June 12, 2019, police officers, acting on information from members of the public, raided Juma’s rented house located in the Murram area of Kakamega Central Sub-County.
A search of the house led to the recovery of 22 brooms containing five kilograms of bhang, valued at approximately Sh16,600.
Juma was arrested and charged under Section 4(a) of the Narcotic Drugs and Psychotropic Substances (Control) Act, No. 4 of 1994.
Prosecution, led by Assistant Director of Public Prosecutions Lazarus Sirtuy and Prosecution Counsel Stephanie Akinyi, presented evidence that proved the case beyond reasonable doubt.
After considering the evidence, magistrate David Wambua found Juma guilty and handed down the 50-year sentence or Sh50 million fine.
