A citizen by the name Mr. Rashid Mohammed through his lawyer Mr. Kioko Kilukumi have written to the Ethics and Anti Corruption Commission (EACC) against the conduct of the registrar of the supreme court Esther Nyaiyaki.
He said that the judgement of the Supreme Court heavily relied on the report of the registrar especially the majority judgement. However dissenting judge Njoki Ndung’u went through the forms and found that all forms were in order with regards to serial numbers stamps and signatures.
The letter says that it is an inevitable conclusion that the report by the supreme court registrar was either ‘doctored’ or the forms which she based her report on were ‘doctored’.
He said that there is prima facie evidence that there was an offense to subvert the course of justice among other criminal offenses.

The letter is addressed to the EACC as the registrar is a state officer. The letter has been copied to the Director of public prosecution, the inspector general and the director of criminal investigations.
