    Monda impeachment: Key witness recants testimony, says promise of job drove him to perjury

    The prime witness in the impeachment proceedings against former Kisii Deputy Governor Robert Monda has filed an affidavit to recant his testimony.

    Denis Mokaya Misati further thrashed all pieces of evidences adduced both at the Kisii County Assembly and the Senate terming as fake and squeezed out of him under duress.

    Misati had accused Dr Monda of taking from him more than Sh800,000 as bribe to influence his employment at the Gusii Water Sanitation Company, a job that did not materialize.

    The impeachment charges-that of gross misconduct, abuse of office and commission of crime under national law by Monda – both at the Kisii County Assembly and the Senate relied heavily on Misati’s testimony.

    In the rumbling five page affidavit, Misati now says he was called and met a senior official in the county who promised him a job as long as he agreed to testify against his deputy.

    “After agreeing, i was given Dr Monda’s Mpesa statement on 28th, May 2024. I have never visited Dr Monda’s office before neither did i give him any cash,” stated Misati in the stunning about- turn testimony.

    Misati said it was true he had some cash from his father to Dr Monda

    and as instructed, used his number to send him some money.

    Even in the face of coercion, said Misati, he for sometime stood his ground against being weaponised against Monda who was a family friend.

    Later, he accepted the deal on account of the reward promised by the official.

    “It was a case of carrot and stick and i had no other way out as i was desperate. I was caught between a hard rock and a hard place and chose the path of least resistance that is i cooperated with them because i feared for my life and that of my family,” stated Misati.

    In the affidavit, Misati now denounces all the pieces of evidence adduced before the County Assembly and the Senate.

    He said he did not sell his business to fund the bribery as claimed during the witnessing.

    “Today, out of my actions, i feel haunted by my actions which are in disharmony and in discord with our once united family. That i no longer have a relationship with my father and mother and not spoken since i testified under duress and undue influence from the governor and his handlers.”

    ” It haunts and torments me to date for giving false witness statement against the Deputy Governor of Kisii. And as a Christian my life has never been the same for being used against an innocent leader,” he said.

    The reason for the swearing of the affidavit, Misati says, is to stand for truth regardless of the consequences.

    He speaks of a scripted witness statement that dictated to him to even “shed crocodile tears to milk public sympathy”.

    “I thus recant the testimony for the sake of my conscience which has been tainted and affected my mental and emotional well being forcing me to seek medical help,” he said.

    The affidavit was signed before Khisa K Wekesa of Mayogi Nyaribo and Company Advocates in Nairobi.

    It is not clear if the move has any implications for now.
