Former Ruaraka OCS Nahashon Mutua has been convicted with the murder of an inmate on December 19, 2013.

While making the ruling, Justice Stella Mutuku noted that the deceased, Martin Koome was not assaulted by fellow inmates but by the accused person.

“The Prosecution has proved beyond reasonable doubt that the deceased was assaulted in the cell…..The accused misused his authority under the Constitution,” she said.

Mr Mutua has denied the charges and has insisted that Koome was drunk, badly beaten by fellow inmates and upon reviewing his case directed that he be taken to hospital.

According to the Prosecution, the former OCS ordered Koome to immerse his head in a drum of water for about 30 minutes.

It is then that he hit him on the back of his head with a rod and taken back to the cell.

The Independent Policing Oversight Authority (IPOA) later recommended that Mutua be arrested and charged with murder.

The DPP was in agreement with IPOA and directed that the accused person be prosecuted.

Koome died on December 20 while receiving treatment at the Kenyatta National Hospital (KNH).

The case will be mentioned on December 20.
