Supreme Court Judge Njoki Ndung’u is set to record a statement at the Directorate of Criminal Investigations (DCI) offices on Tuesday over graft claims.

Divulging this to the Star, DCI director George Kinoti noted that the apex court judge had made a request to record the statement through her lawyers.

In a statement presented to Mr Kinoti, Ms Ndung’u stated that she is responding to the allegations that a petitioner, Jared Ngeri accused her of.

Mr Ngeri had claimed that justice Ndung’u had engaged in corruption and hence wanted her to be removed from her position.

“Our clients takes the allegations against her extremely seriously. These allegations suggest criminally culpable conduct on the part of the judge,” one of her advocates Andrew Musangi wrote.

Furthermore, Musangi asserted that the allegations against Ndung’u must be investigated by the  DCI despite a separate Judicial Service Commission proceedings going on.

“While maintaining her innocence … our client strongly believes that it is important that any criminal investigation against her is investigated,” Musangi stated.

Musangi asked the DCI to immediately and thoroughly investigate all the allegations of improper communications between  Ndung’u  and any of the stated persons in the petition including but not limited to accessing all relevant telephone records from all service providers.

Additionally, he stated: “Investigate all alleged leakage of the judgment of the Supreme Court to any nonauthorized party. Investigate all comments on the judgment prior to delivery to determine if they  were borne of corrupt practice or any other criminal  breaches.”

The Judicial Service Commission is reported to have begun hearing the petitions against 11 judges including Ndung’u.
