
Chief Magistrate Lawrence Mugambi has ruled that the proceedings against Deputy Chief Justice (DCJ) Philomena Mwilu shall rest at the point at which they had reached.
The court also ruled that two weeks before the hearing at the high court on October 9, there shall be a mention at the chief magistrates court to update the court on the directions of the High court.
The Ruling applied to DCJ Mwilu and the second accused, Stanley Muluvi who will appear in court on September 5.
Mwilu appeared before the chief magistrates court to determine whether she would take a plea or the amended stay orders would be applicable.
The prosecution led by Ms Dorcas Oduor said that the office of the directorate of public prosecution was committed to obey court orders. They said that although a lot of resources had been incurred they respect the fact that the DCJ was represented by an array of senators and members of parliament. The office of the DPP is accountable to the members of parliament that also represent the people.
The prosecution said that these orders before the court did not apply to the second accused person who the lawyer of DCJ Mwilu at the time of the transaction.

The office of the prosecution said that this case should not be seen as an attack towards the Judiciary and that they are committed to follow the rule of law.
